THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO Criminal Petition No.10047 of 2018 ORDER :

The petitioner is A.2 among 6 accused of C.C.No.747 of 2015 on the file of the VI Metropolitan Magistrate, Cyberabad at Medchal, Ranga Reddy District, outcome of Cr.No.572 of 2014 of Dundigal Police Station registered for the offence punishable u/ sec.384 IPC on the report of the 2nd respondent/ defactocomplainant and the police after investigation filed chargesheet and the learned Metropolitan Magistrate concerned has taken cognizance for the offence punishable under Section 384IPC from the police final report and after appearance, there was a compromise in pending quash petition Crl.P.No.14807 of 2016 moved by the A.1, A.3 to A.6 but for the present petitioner's absence, he could also be included in that case and this Court another Bench accorded permission in Crl.M.P.No.

16806 of 2016 to compound the offence and quash the said proceedings. Once that is the material and defacto-complainant is even not traced now though appeared in that compromise proceedings from the notice sent to the address not served and returned for no useful purpose will be served to keep the matter pending with the ordeal of the trial, the proceedings in the above crime are liable to be quashed.

Having regard to the above, the Criminal Petition is allowed by quashing the proceedings in C.C.No.747 of 2015 on the file of the VI Metropolitan Magistrate, Cyberabad at Medchal, Ranga Reddy District, outcome of Cr.No.572 of 2014 of Dundigal Police Station against the petitioner/ A.2 and he is acquitted. His bail bonds shall stand closed.
