THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.8188 OF 2016

O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in D.V.C.No.15 of 2015 on the file of Judicial First Class Magistrate, Metpaly, registered against the petitioners herein, who are respondents 2 to 6 before the trial court, for the offence punishable under Sections 17, 18, 19, 20, 22 read with 31 of Domestic Violence Act, 2005. Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order, without insisting the presence of the petitioners herein, who are respondents 2 to 6 before the trial court, on each and every date of hearing, unless required for any specific purpose.

Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:16.06.2016 AVS
