THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.26675 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Standing Counsel for Greater Hyderabad Municipal Corporation appearing for the respondents.

This Writ Petition is filed assailing the notice dated 26.07.2016 issued under Section 452 of the Hyderabad Municipal Corporations Act, 1955 by the 3rd respondent. Earlier, a show cause notice dated 11.07.2016 had been given by the 3rd respondent to which the petitioner had submitted its reply on 18.07.2016. But, without considering the same, the present impugned notice dated 26.07.2016 was issued.

Learned Standing Counsel for GHMC has placed before this Court the proceedings dated 08.08.2016 issued by the 3rd respondent withdrawing the notice dated 26.07.2016 issued by him. In view of the above, the cause in the Writ Petition no longer survives for adjudication. However, the 3rd respondent is directed to consider the petitioner's reply dated 18.07.2016 to the show cause notice dated 11.07.2016 issued by him, pass a reasoned order and communicate his decision thereon to the petitioner. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand dismissed.
