THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7207 OF 2017 ORDER:

Heard learned counsel for the petitioner and also the 2nd respondent - State, represented by learned public prosecutor, before ordering notice to the 1st respondent, to whom notice unserved even earlier in the quash petition filed by A1 to A6 covered by Crlp.No.5956/2016 and perused the grounds urged in the quash petition and the police final report and the order of another bench of this court referred supra in Crl.P.No.5956 of 2016, dated 15.03.2017, quashing the proceedings of the calendar case against the other accused 1 to 6 with observation that the continuation amounts to abuse of process from the defacto complainant's non-cooperation from she already married and living elsewhere and not turning up despite the matters are settled other matters with finality putting an end to the marital tie. 2.

Having regard to the above and in view of the covered judgment, this petition is also allowed, quashing the proceedings against the petitioner. Bail bonds executed if any stands cancelled.

Accordingly and with the above direction, this criminal petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed.
