HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.6961 of 2011 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings against the petitioners in Cr.No.132 of 2011 on the file of Samalkot P.S., East Godavari District, registered for the offences under Sections 447, 353 IPC and Section 3 of Prevention of Damage to Public Properties Act, 1984. It appears to be a clear case of political rivalry and hurting the egos of one another. The additional classrooms which were to be inaugurated by the local M.L.A., on 23.06.2011 at 9.00 a.m., were inaugurated by the M.L.C. Hence, there is violation of protocol. The petitioners/accused have stated that it happened due to lack of information, in view of communication gap and it was unintentional. In that view of the matter, the criminal petition is allowed, setting aside the proceedings against the petitioners in Cr.No.132 of 2011 on the file of Samalkot P.S., East Godavari District. As a sequel, miscellaneous petitions if any pending stand closed.
