C.B.C,I.D, Hyderabad, pending disposal of CRLP No. 10083 of 2018, on the file of the High Court.
CRLP No. 1OOa3 of 2018: Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the groqrtds filed in support of the petition, the High Court may be pleased to grant Anticipatory bail to the Petitioner by directing the Respondent to release the Petitioner in the event of his arrest in Crime No.7 of 2015 of Hyderabad CJI Police Station;
The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and the order of the High Court dated 27 -09-2020 made in CRL.P. No. 10083 of 2018 herein and upon hearing the arguments of SRI A.V. GOPLA RAO, Advocate for the Petitioner and of PUBLIC PROSECUTOR, For the Respondent, the Court made the following ORDER:
This application is filed seeking to relax condition No.2 imposed by this Court in the order dated 27.09,2018 in Crl.P.No.10083 of 2018. The petitioner is A23 in Crime No,7 of 2015 pending on the file of Hyderabad CID Police Station, The offences alleged against the petitioner are under Sections 406,42O read with 12OB IPC. This Court vide order dated 27.o9,2O1a this Court granted anticipatory bail on imposition of certain conditions including the condition that the petitioner shall appear once in a month either on l't Sunday or any such other date fixed by the Investigating Officer before the respective CB CID Investigating Officials of the 7 Regional Offices of State of Andhra Pradesh and such Regional Offices of State of Telangana respectively till end of trial for assurance of his availability and non-interference in any manner vftth the witnesses.
Learned counsel for the petitioner would submit that the petitioner has been complying with the order of this Court and there is no allegation against the petitioner that he has violated any of the conditions imposed by this Court and also he is threatening the witnesses,
On instructions, learned Public Prosecutor, would submit that the Police have completed the investigation and only charge sheet has to be filed.
Considering the above said fact that there is no allegation against the petitioner/A23, this Court is inclined to relax the said condition No,2 imposed by this Court. However, it is made clear that other conditions imposed in the order remain unaltered, The petitioner shall cooperate with the Investigating Officer by appearing before him as and when his presence is required.
