THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.13105 OF 2013 ORDER:

This Criminal Petition is filed under Section 482 of the Criminal Procedure Code to quash the proceedings in Crime No.234 of 2013 on the file of Bapatla Town Police Station, Guntur District.

Learned Public Prosecutor for the State of Andhra Pradesh represented that the charge sheet is filed on 29.11.2014 before the Judicial First Class Magistrate against these two petitioners also arraying them as Accused Nos.2 and 3.

Sri P.Sridhar Reddy, learned counsel for the petitioners, informed that an order of stay of all further proceedings in the above Crime was granted in a quash petition filed under Section-482 Cr.P.C. by one of the accused in the above Crime and the proceedings against accused Nos.5 and 6 were already quashed.

Admittedly, no stay was granted in the present Criminal Petition and if, for any reason, the prosecuting agency violated the order of stay passed in the Criminal Petition filed by one of the accused in the above Crime, it is left open to the petitionersAccused Nos.2 and 4 to take appropriate steps. But, in the

absence of any stay, filing of charge sheet against these petitioners by the prosecuting agency cannot be found fault. Hence, the Criminal Petition became infructuous and consequently, the same is dismissed.
