THE HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.6441 of 2015 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader of Revenue.

The petitioner prays for Mandamus, directing respondent Nos. 2 and 3 to receive the sale deed dated 05-12-2014 executed for the property covered by D.No.543/H, an extent of Ac.0.87 cents in Ammenabada Village of Phirangipuram Mandal, Guntur District and complete the registration in accordance with law. The Court ordered notice on admission.

The 3rd respondent filed counter affidavit. One of the objections stated in the counter-affidavit is that the writ petition is filed without there being a cause of action and that if the petitioner presents the document before the 3rd respondent along with pattadar pass book, title deeds, etc., the respondent will receive the document and process the same in accordance with the Registration Act, Stamp Act and the Rules made under the respective enactments and pass orders. At the time of hearing, Sri V.S.R. Anjaneyulu, learned counsel for the petitioner submits that the petitioner has pattadar pass book as well as title deed for the subject-matter of the writ petition and without expanding

the issue he states the petitioner will present the sale-deed for registration before the 3rd respondent.

The writ petition is ordered by firstly giving liberty to the petitioner to present the document for registration for the subject-matter of the writ petition, and secondly, on presentation of such document for registration, the 3rd respondent is directed to receive the document, process the same in accordance with the Registration Act/Stamp Act, and complete the registration forthwith.

The miscellaneous petition filed in the writ petition shall also stand disposed of. There shall be no order as to costs.
