HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33981 of 2018 ORDER:
1) Heard.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.3 and 4 and their subordinates in interfering with the possession and enjoyment of the petitioner in respect of land admeasuring Ac.1.00 guntas in Survey No.5/2/a, situated at Kothapalli revenue village, Chirla mandal of Bhadradri, Kothagudem District, without issuing any notice, as illegal and arbitrary.
3) At the time when the matter is taken up for hearing, learned Government Pleader for revenue would submit that there is a dispute between respondent Nos.5 and 6 with regard to the ownership and title of the property and that the civil Court is seized of the matter. He further submits that as the land in question is a patta land, Tahsildar is no way concerned with the dispute and has no authority in obstructing or interfering with the same.
4) With the above submissions, the writ petition is disposed of. It is made clear that any interference in future, in respect of the subject property, shall only be in accordance with law.
