THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.13839 of 2015 ORDER:

The petitioners pray for Mandamus declaring the action of respondents 2 and 3 in not receiving and registering the family settlement deed presented by the petitioner for plot No.35-A in Sy.No.74/6, in an extent of 350 sq.yards, covered by Municipal Property No.10-3-P35, Junas Manson, East Marredpally, Secunderabad as illegal and unconstitutional.

Having regard to the inaction complained against the respondents herein, this Court is not considering the other submissions canvassed by the learned counsel for the petitioners and the learned Government Pleader.

Suffice it to observe that the Sub-Registrar/3rd respondent cannot even refuse to receive a document and consider the same for registration under Registration Act. The petitioners are given liberty to present the family settlement deed for the property, referred to above, before the 3rd respondent; the 3rd respondent is directed to receive the document, process the same for registration, and for any reason, the 3rd respondent is of the view that the document cannot be registered, he is under obligation to pass an order and communicate the same to the petitioners; in the alternative, if the document compliant in all aspects and not prohibited for registration, the registration shall be completed within one week from the date of presentation.

The Writ Petition is disposed of, as indicated above. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed in consequence. ______________ S.V.BHATT,J Date: 01.05.2015 Dsr
