THE HON'BLE DR. JUSTICE SHAMEEM AKTHER TRANSFER CRIMINAL PETITION No.85 of 2017 ORDER:

There is no representation for the petitioner. Heard learned Public Prosecutor for the State appearing for respondent No.1 and learned counsel for respondent No.2. The main allegation in this Criminal Petition is, the Presiding Officer is not properly recording the evidence and the same is brought to the notice of the Presiding Officer by the petitioner, who is the de facto complainant and P.W.1 in Sessions Case No.65 of 2013.

It is brought to the notice of this Court that the said Presiding Officer has been transferred and some other Officer has taken over the charge.

Under these circumstances, this Court is of the view that there are no justifiable grounds to entertain this Transfer Criminal Petition.

Therefore, the Transfer Criminal Petition is dismissed. Pending miscellaneous applications, if any, shall stand dismissed in consequence.
