HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25454 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the respondents in considering the representation submitted by the petitioner dated 02.04.2016 and 04.04.2016 for his reappointment of Fair Price Shop dealership of Shop No.11 at Toolekhurd Village, Yacharam Mandal, Ranga Reddy District, as illegal and arbitrary. Heard the learned counsel for the petitioner, the learned Government Pleader for Civil Supplies and the learned Government Pleader for Revenue for the State of Telangana. The case of the petitioner is that the petitioner was appointed as a Fair Price Shop Dealer of shop No.11 of Toolekhurd Village, Yacharam Mandal of Ranga Reddy District on 05.06.2010. His authorization was cancelled on 30.09.2010 on the following two grounds:
1. The father of the petitioner is an employee; and
2. A Criminal case was pending against the petitioner. The contention of the petitioner is that merely because his father is a government employee itself is not a valid ground for cancellation of his authorization.
At the time of arguments, the only relief sought by the petitioner is to direct the third respondent to dispose of his representation dated 02.04.2016.
In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the
main case.
Having regard to the facts and circumstances of the case and also the submission made by the learned counsel for the petitioner, the third respondent is hereby directed to dispose of the representation of the petitioner dated 02.04.2016 in accordance with law within a period of two months from the date of receipt of this order.
Accordingly, the writ petition is dispose of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
