HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 38627 of 2013 ORDER:

This writ petition is filed to declare the inaction of the official respondents in initiating steps to stop the illegal constructions being undertaken by respondent Nos.6 & 7 in Sy.No.1182/ 1C9, situated at Addanki, Prakasam District, as illegal and arbitrary and a consequential direction was also sought to direct the respondent Nos.2 and 3 to take immediate measures to close the Fried Gram Mill (Dall Mill). Heard the learned counsel for the petitioners, learned Standing Counsel for 5th respondent and the learned counsel appearing for respondent Nos.6 and 7.

Learned Standing Counsel for the 5th respondent submits that the unofficial respondent Nos.5 and 7 have not obtained necessary permission in accordance with Sections 264 and 265 of the A.P. Municipalities Act, 1965.

Learned counsel appearing for the unofficial respondents submits that before taking any action, notice and opportunity has to be given to the unofficial respondents.

In view of the facts and circumstances of the case, the official respondents are directed to take action, in accordance with law, after giving notice and opportunity to both the petitioners and unofficial respondents 6 and 7.
