HON'BLE SRI JUSTICE S. RAVI KUMAR SECOND APPEAL No.1246 of 2003 JUDGMENT:

This appeal is preferred challenging the judgment and decree in A.S.No.400 of 2000 on the file of I Additional Senior Civil Judge, Visakhapatnam, dated 20.03.2001, whereunder judgment and decree dated 27.09.1996 in O.S.No.137 of 1985 on the file of District Munsif, Bheemunipatnam is confirmed. When this matter was listed on 08.06.2015, there was no representation for both sides and the matter was listed under the caption 'for dismissal'. On 23.06.2015, when the matter came up for hearing, learned counsel for appellants sought time and made a request to delete from the caption of dismissal and this court considered the request of appellants, posted the matter to 30.06.2015 under the caption 'for hearing'.

But today when the matter came up for hearing, there is no representation on behalf of appellants. It seems that appellants are not interested to prosecute this case.

Advocate for respondents represented that this appeal is coming since 2003 and the appellants have not shown any interest. Considering the above reasons, this Second Appeal is dismissed for nonprosecution. No costs. Miscellaneous petitions, if any pending, in this appeal petition shall stand closed.
