This writ petition is filed alleging that the registering authority is refusing to register the documents presented by the petitioner in respect of Plot No.112, admeasuring 200 Square yards in Sy.Nos.37, 41 to 47 of Miyapur village, Boduppal Gram Panchayat, Ghatkesar Mandal, Ranga Reddy District the then now Medchal District and the same is illegal.

When the matter is taken up, learned Standing Counsel representing the State Waqf Board produced photo copies of the Gazette notification showing the subject properties as the Waqf properties. The District Collector, Ranga Reddy District addressed letter to the Sub-Registrar, Narapally Village, Ghatkesar Mandal, Ranga Reddy District, as early as 28.08.2008, enclosing a copy of the Gazette notification.

Since the property claimed by the petitioner is already included in the prohibited list of properties, it cannot be said that the registering authority erred in not accepting the documents presented by the petitioner for registration. 4.

If petitioner is aggrieved by the action of the respondentauthorities in holding the subject properties as Waqf properties, and publishing them in the Gazette and informing the registering authorities not to undertake registration, petitioner has to avail the remedy as available in law. It is also open to the petitioner to apply to the Chief Executive Officer of the State Waqf Board, by

- 3 - placing reliance on the material in support of his claim and on such application being made, it is open to the Chief Executive Officer to examine the claim vis-à-vis the statutory provisions and furnish a suitable reply, as warranted by law. 5.

Subject to the above observations, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
