The State Of Andhra Pradesh, v. G. Uma Devi,
THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No. 42869 of 2016 ORDER: (Per VRS,J) The State has come up with the present writ petition, challenging an order of the Andhra Pradesh Administrative Tribunal, directing the Government to treat the period from 04.09.2011 to 31.03.2012 as duty period for the 1st respondent herein. 2.
Heard the learned Government Pleader for Services (A.P.) appearing for the petitioners.
3.
It appears that the 1st respondent was appointed as a Language Pandit and issued with posting orders on 04.02.2011. But, on an application filed by some other candidate before the Andhra Pradesh Administrative Tribunal, she was relieved on 27.09.2011 and directed to join at another place. She got impleaded in the original application filed by the other candidate and also got the original application dismissed. After the same, she was issued with reposting orders only on 28.03.2012. After joining duty on 31.03.2012, she claimed the period from 27.09.2011 to 31.03.2012 to be treated as on duty. The Tribunal allowed the application partly, declaring the entitlement of
VRS,J & GSP,J WP No.42869 of 2016 the 1st respondent to have the period only from 27.12.2011 to 31.03.2012 as duty period. It is against this order that the State has come up with the above writ petition.
4.
In brief, what the 1st respondent wanted before the Tribunal was the regularization of the period of about six months. What the Tribunal granted was the regularization of the period of only four months. As against such an order, we do not know why the State should come up with a writ petition. Therefore, the Writ Petition is dismissed.
Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed. No order as to costs. __________________________ V. RAMASUBRAMANIAN, J _____________________ G. SHYAM PRASAD, J 9th December, 2016 cbs
