HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Writ Petition No.6527 of 2012 ORDER:

The petitioners seek a writ of Mandamus declaring the action of the 1st respondent in calling the petitioners to Habeebnagar PS, Hyderabad and pressurizing them to enter into compromise with respondents 2 and 3 in respect of house property bearing No.11-12-182 situated at Nampally Market, Hyderabad as per the terms of respondents 2 and 3 as illegal, arbitrary and consequently direct the 1st respondent not to interfere with the civil disputes between the petitioners and respondents 2 and 3 pending before the High Court in S.A.No.1514 of 2011. 2) When the matter came up for hearing today, there is no representation for petitioners.

3) Learned Government Pleader for Home (TG), on written instructions, would submit that 1st respondent never pressurised the petitioners to enter into any compromise with respondents 2 and 3 except in Cr.No.34 of 2012 which was registered as per the complaint lodged by 2nd respondent for the offences under Sections 419, 420, 465, 468, 471 r/w 120B IPC against the petitioners and the police have never interfered with the activities of the petitioners.

4) As can be seen, this Court in WPMP No.8282 of 2012 passed the following interim order.

" It is stated that in S.A.No.1514 of 2011 filed by the petitioners before this Court, there is an interim order of stay of their dispossession from the house property in question.

In that view of the matter, there shall be a direction to the 1st respondent not to interfere with the property, which is subject matter of S.A.No.1514 of 2011. However, it is made clear that the 1st respondent may proceed with the investigation in Crime No.34 of 2012 and further, he is directed not to take steps for arrest of the petitioners, pending further orders."

5) In view of the above order and the submission of learned Government Pleader, there is no need to pass any final order in this writ petition.

6) Accordingly, this writ petition is closed. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
