HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.19972 of 2015 ORDER : (per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioner seeking Mandamus to declare the action of the respondent-Bank in initiating proceedings against the petitioner under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, as arbitrary and illegal.

This Court, while issuing notice before admission, by order dated 07.07.2015, granted interim direction, as prayed for, on condition of the petitioner depositing Rs.25,00,000/- within a period of four weeks from the date of passing of the said order. Thereafter, the matter was adjourned thrice at request of the petitioner and on 03.09.2015, there was no representation for the petitioner and the learned Standing Counsel for the respondent-Bank represented that the conditional order dated 07.07.2015 was not complied with. As such, the matter was directed to be listed under the caption "FOR DISMISSAL".

Today, despite the matter being listed under the caption "FOR DISMISSAL", when the matter is called for hearing, learned counsel for the petitioner is not present and there is no representation on his behalf.

Accordingly, this writ petition is dismissed for non-
