HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.34043 OF 2018 ORDER:
Heard the learned counsel for the petitioners and Sri N. Venkateswarlu, learned, learned Standing Counsel respondent No.2 - Municipality.
2. When the matter is taken up, it is submitted by the learned Standing Counsel that Railway Department is the owner of the subject land; that Municipality addressed a letter to the Railway Authorities to give subject land for purpose of widening the road, and in turn the Railway Authorities gave a reply to provide alternative accommodation, and for identifying the same, it will take some more time, that out of apprehension, the petitioners approached this Court and that no action as on today is being taken, and if any action is warranted, the respondent - municipality will follow the due process of law.
3. Recording the above submission, the present Writ Petition is disposed of. However, if any cause of action arises, liberty is given to the petitioners to approach this Court seeking necessary relief. No order as to costs.
As a sequel, Miscellaneous Petitions, if any, pending in the present Writ Petition, stand closed.
