HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.26934 of 2017 ORDER:

In this writ petition, the petitioner is challenging the notice dated 11.11.2016 issued by the 3rd respondent, whereby the date of birth of the petitioner was sought to be altered from 02.09.1962 to 01.07.1961 and an opportunity was given to the petitioner to submit his explanation within seven days.

Heard the learned counsel for the parties.

No interim orders are passed in this writ petition and it is submitted by the learned counsel for the petitioner that on 08.03.2017, the petitioner has submitted explanation to the impugned show cause notice and thereafter the respondents have passed final orders on 01.01.2019. Since the respondents have passed the final orders on 01.01.2019 in pursuance of the impugned show cause notice, this Court is of the considered view that even if the show cause notice dated 11.11.2016 is set aside, the final orders will be staring at the petitioner, therefore the petitioner has to challenge the said final orders, if so advised. In view of the above observations, the cause in the writ petition does not survive and the writ petition is accordingly dismissed. However, the petitioner is given liberty to challenge the final orders dated 01.01.2019, if so advised.
