HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.No.6177 of 2015 ORDER:

This Criminal Petition is filed Under Section 482 Cr.P.C. by the Petitioner-A6 to quash the proceedings initiated against him in Crime No.30 of 2015 of I Town Police Station, Vizianagaram District, registered for the offences punishable under Sections 409, 420 and 120-B I.P.C.

On a complaint given by the 2nd respondent herein, a case in Crime No.30 of 2015 was registered against the petitioner and others by the Inspector of Police, I Town Police Station, Vizianagaram District for the offences punishable under Section 409, 420 and 120-B I.P.C. Heard the learned Counsel appearing for the petitioner and the learned Public Prosecutor, representing the State.

The allegations in the complaint prima facie reveal the commission of alleged offence by the petitioner herein and other accused. It is a matter, which requires investigation by the police. Therefore, I see no grounds to interfere at this stage with the investigation of the case.

Having regard to the aforesaid facts and circumstances of the case, the Criminal Petition is disposed of with a direction to the Investigating Officer to proceed with the investigation expeditiously, however, the petitioner-A6 shall not be arrested without following the procedure as

contemplated under Section 41A Cr.P.C.

Miscellaneous petitions, if any, pending shall stand closed.
