HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 34130 of 2018 ORDER:

1) Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not granting consent for the conversion of petitioners' land admeasuring Acs.8.00 guntas in Survey No.5/18 and Acs.8.00 guntas in Survey No.5/2, 5/2A in total extent of Acs.16.00 guntas, situated at Peddanapalli village of Kasipet mandal, Mancherial District from agricultural land to non agricultural land, though they made representation dated 10.05.2018 to respondent No.3, as illegal and arbitrary.

3) At the time when the matter is taken up for hearing, learned counsel for the petitioners would submit that in the cause title, a mistake occurred inadvertently showing 'Revenue Divisional Officer, Mancherial' in place of 'Revenue Divisional Officer, Bellampally'. Hence he seeks deletion of the word 'Revenue Divisional Officer, Mancherial' and replace it with 'Revenue Divisional Officer, Bellampally'.

Hence, Registry shall replace the word 'Revenue Divisional Officer, Bellampally' in place of 'Revenue Divisional Officer, Mancherial' in the cause title.

4) Learned counsel for the petitioners would submit that though the petitioners made application in the month of May, 2018, till date no orders are passed on the said application. 5) Learned Government Pleader for revenue would submit that if the said application is still pending consideration, the same would be disposed of, at the earliest.

6) Recording the above submission, the writ petition is disposed of directing respondent No.3 i.e., Revenue Divisional Officer to dispose of the application made by the petitioners on 10.05.2018 seeking consent to convert their land admeasuring Acs.8.00 guntas in Survey No.5/18 and Acs.8.00 guntas in Survey No.5/2, 5/2A in total extent of Acs.16.00 guntas, situated at Peddanapalli village of Kasipet mandal, Mancherial District from agricultural land to non agricultural land, in accordance with law, as early as possible, preferably within a period of three months from the date of receipt of a copy of the order.
