HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 14433 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents,.

The petitioner is a Fair Price Shop Dealer of Shop No. 680 of NTR Nagar, L.B.Nagar, Saroornagar Mandal, Ranga Reddy District. The third respondent inspected the shop of the petitioner on 23.04.2015 along with staff and found no

irregularities. However, the learned Counsel for the petitioner submits that at the instance of the local political leaders, the authorities wanted to register a case against the petitioner under Section 6-A of the Essential Commodities Act and accordingly conducted a panchanama alleging variation in the ground stock available in the shop. Thereafter a show cause notice was issued to the petitioner on 02.05.2015 alleging two charges against the petitioner. The said two charges are relating to variation in the stock. Along with the show cause notice, the authorization of the petitioner was suspended on the same day. So far the petitioner did not submit her explanation to the said show cause notice and directly filed the present Writ petition questioning suspension of his authorization.

This Court is not inclined to consider the proprietary of the allegations made against the petitioner. Having regard to the facts and circumstances of the case, the Writ Petition is disposed of giving liberty to the petitioner to submit his explanation within ten days from the date of receipt of a copy of this order and the second respondent shall consider the said explanation and pass appropriate orders within thirty days thereafter by observing principles of natural justice.

The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
