This petition is filed seeking for quash of the proceedings against the petitioner, who is A4, in Crime No.4 of 2008 on the file of Parchur Police Station, Prakasam District. 2.

Heard the counsel for the petitioner; the Public prosecutor appearing for the 1st respondent; the counsel appearing for the 2nd respondent.

The counsel for the petitioner draws the attention of this Court to the orders in Crl.P.No.254 of 2008, quashing the proceedings against A1 to A3.

A perusal of the complaint shows that the name of the petitioner is no where mentioned in the complaint as a person, who has committed the alleged offence. This Court in the above criminal petition has considered the said facts and came to a conclusion that there was not even, prima facie, probability to link up the petitioners with the business in fertilizers. Same is the case with the petitioner herein.

Hence, on the same terms and following the said order, this criminal petition is allowed and the proceedings in Crime No.4 of 2008 on the file of Parchur Police Station, Prakasam District are hereby quashed.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
