In all these writ petitions, the petitioners challenged the demand of balance amount pursuant to the allegation of theft of electricity even though they have paid 50% of the demanded amount. The learned Standing Counsel for the respondents submits that if the petitioners had paid 50% of the demanded amount, the respondents would refer the matter to the Special Court, constituted under Section 154(5) of the Electricity Act, in case of theft of electrical energy for determination of civil liability and without demanding further amount from the petitioners. The learned counsel for the petitioners submits that even after payment of 50% of the amount as indicated in the writ petitions, the service connection of the petitioners was disconnected.

In the above circumstances, these writ petitions are disposed of directing the respondents to restore power supply to the petitioners if the petitioners had paid 50% of the amount demanded, and the respondents are directed to refer the matter to the Special Court, constituted under Section 154(5) of the Electricity Act, for determination of civil liability. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in these writ petitions shall stand closed.
