HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 1733 of 2017 Order:

This Writ Petition was filed seeking a direction to the respondents 2 and 3 to complete the investigation in Crime No.210 of 2015, dated 25.06.2015, of Naidupet Police Station, SPSR Nellore district and to file the final report.

A counter affidavit is filed stating that during the course of investigation the Investigating Officer examined 48 witnesses and recorded their statements. Though, all possible steps were taken to detect the case by constituting special parties, there was no progress. It is also stated that there is no hope to detect the case in near future. If any clues come to light in future, the above case will be reopened and further action will be taken to finalize the same. In view of the same, the Investigating Officer addressed a letter to the second respondent, the Superintendent of Police, SPSR Nellore district on 08.02.2017 and after receiving orders from the second respondent a final report will be filed before the concerned Court.

In view of the above facts, the second respondent is directed to consider the report submitted by the third respondent and pass appropriate orders in accordance with law within a period of thirty (30) days from the date of receipt of a copy of this order. After receipt of the orders from the second respondent, the third respondent shall take appropriate action.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
