THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4843 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners/A.2 and A.3 seeking bail in crime No.66 of 2015 on the file of P.S., Suryapet Town, Nalgonda District, registered for the offence under Section 379 IPC and 20(b) of the NDPS Act.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

Learned counsel for the petitioners submits that the petitioners were not arrested at the time of occurrence and nothing is recovered from them. Even though they belong to the State of Uttar Pradesh, they are ready to give sureties, who are native of Telangana State. Further, it is the contention of the learned counsel for the petitioners that the petitioners were arrested on 11.03.2015 and that even though 90 days have lapsed, charge sheet is not filed and as such, prays this Court to grant bail to the petitioners/A.2 and A.3.

Learned Public Prosecutor submits that if they are released on bail, they will be free from the hands of justice and it will be difficult to secure them as other case is also pending against them.

Considering the facts and circumstances of the case, the petitioners shall be enlarged on bail on condition of their executing personal bonds for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties pertaining to the State of Telangana, for the like sum each to the satisfaction of the Judicial First Class Magistrate at Suryapet, Nalgonda District. The petitioners are directed to report to the Station House Officer concerned, daily between 10 A.M. and 5 P.M. until further orders.

The Criminal Petition is accordingly allowed.
