HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.6825 of 2011 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings against the petitioners in D.V.C.No.104 of 2011 on the file of the IV Metropolitan Magistrate, Hyderabad.

The 2nd respondent is the de-facto complainant and the petitioners herein are the accused. The 2nd respondent has filed complaint aggrieved by the harassment made by the petitioners. There is divorce O.P.No.146 of 2011 pending on the file of the Family Court, City Civil Court, Hyderabad.

Without expressing any merits of the case, the criminal petition is disposed of, leaving all legal remedies open to the petitioners. Interim stay granted on 09.08.2011 vide Crl.M.P.No.7046 of 2011 stands vacated. However, the petitioners shall not be arrested during pendency of the proceedings before the Court below. As a sequel, miscellaneous petitions if any pending stand closed.
