THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 13587 of 2011 ORDER:

The grievance of the petitioner in this case was that the police authorities were not initiating process for arrest of the accused in Crime No.19 of 2011 on the file of the Kaikaluru Rural Police Station, Krishna District. Basing on the written instructions dated 30.05.2011 received from the Station

House Officer, Kaikaluru Police Station, Krishna District, the learned Assistant Government Pleader for Home stated that the private complaint filed by the petitioner before the learned Judicial Magistrate, Kaikaluru, was forwarded to the Kaikaluru Rural Police Station, Krishna District, and was registered as Crime No.19 of 2011 under Section 354 I.P.C read with Section 34 I.P.C. Upon due investigation and examination of nine witnesses, including the petitioner herein, the police authorities found that no case was made out. After obtaining permission from the Sub Divisional Police Officer, Gudivada, a report was filed under Section 173 Cr.P.C that the case was a false one.

In the light of the aforestated developments, it is for the petitioner to take appropriate steps in accordance with law upon the adverse final report filed by the police authorities under Section 173 Cr.P.C.

No cause survives for adjudication in this Writ Petition which is accordingly dismissed.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
