THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15174 of 2017 ORDER:

This Writ Petition is filed challenging the action of respondent No.2 in calling the petitioner and his family members to the I Town Police Station, Gudiwada, and asking them to sit hours together without considering their appeal from 19.04.2017 onwards.

It appears from the record that the son of the petitioner is the sole accused in Crime No.85 of 2017 registered on the basis of the complaint lodged by respondent No.4. It also appears that the whereabouts of the accused are not known and in that connection, the petitioner, who is his father, is being called to the Police Station.

The Police who registered the crime have to conduct the investigation in accordance with law, but shall not harass the family members of the accused. In this case there is an allegation of harassment of the family members for the unavailability of the accused.

In the circumstances, this Writ Petition is disposed of directing respondent No.2 not to harass the family members of the accused, but to continue the investigation. If the harassment of respondent No.2 continues, it is open to the petitioner to bring it to the notice of respondent No.3 by a written representation. On receipt of such representation,

respondent No.3 shall take necessary action in accordance with law. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 26.04.2017 vs
