O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.375 of 2015 on the file of IV Additional District Munsif Magistrate, Tirupathi, Chittoor District, registered against the petitioner/A-5 for the alleged offences punishable under Sections 419, 420, 120B read with 34 IPC.

Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioner. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of the case within a period of six months from the date of receipt of a copy of this order, without insisting the presence of the petitioner/accused No.5 unless required for any specific purpose. It is needless to observe that petitioner is at liberty to move trial court for appropriate relief under law, including that of petition for discharge.
