HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8830 of 2015 ORDER:
This criminal petition, under sections 437 & 439 of the Code of Criminal Procedure, is filed by the petitioner-Accused seeking to grant bail in connection with crime No.72 of 2015 on the file of Government Railway Police Station, Samarlakota, East Godavari District, registered for the offences punishable under 8(C) read with 20(b) of the Narcotic Drugs and Psychotropic Substances Act. The case of the prosecution is that on credible information on 07.07.2015, the RPSI along with the mediators rushed to the North side of Platform No.3 of the Samarlakota Railway station and found the accused in possession of four bags, each containing 20 packets of 2 kgs., each. On seeing the police, the accused tried to escape and the police caught him and on enquiry, he stated that some unknown persons offered him the said ganja to sell the same at Chittoor Railway Station at higher price.
Heard and perused the material available on record. A perusal of the record discloses that the seized ganja is about 40 kgs., which is more than the commercial quantity. Hence, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J September 04, 2015 KTL
