THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.7843 of 2017 ORDER:
This petition is filed, by the petitioner-accused No.1, under Sections 437 and 439 Cr.P.C., seeking bail in Crime No.155 of 2017 on the file of the Station House Officer, Miryalguda I Town Police Station, Nalgonda District, registered for the offences punishable under Section 370 I.P.C. and Sections 3 and 4 of the Immoral Traffic (Prevention) Act, 1956.

The learned counsel for the petitioner submitted that the police falsely implicated the petitioner for statistical purpose. 3.
The learned Additional Public Prosecutor opposed the bail petition on the ground that the investigation is in progress. 4.
It is the case of the prosecution that on 04.08.2017 on receiving reliable information, the Sub-Divisional Police Officer, Miryalguda, raided the house of the petitioner and found three ladies and one male person. It is the further case of the prosecution that the petitioner has been running a brothel house by procuring women from nearby villages. After completion of the necessary formalities, the Sub-Divisional Police Officer registered the above case.

The petitioner filed Crl.M.P.No.995 of 2017 on the file of the Court of the VIII Additional District and Sessions Judge, Miryalaguda, and the same was dismissed on 18.08.2017. 6.
A perusal of the record reveals that the petitioner is an accused in Crime No.48 of 2017 for the offences punishable under
Section 370 I.P.C. and Sections 3 and 4 of the Immoral Traffic (Prevention) Act of Miryalguda I Town Police Station and Crime No.66 of 2017 under Section 110(e) Cr.P.C. of Miryalguda I Town Police Station. The record further reveals that the investigation is in progress. As rightly pointed out by the learned Additional Public Prosecutor, if the petitioner is released on bail at this stage, the possibility of tampering with the prosecution witnesses cannot be ruled out completely.

Taking into consideration the facts and circumstances of the case and also the stage of investigation, this Court is of the considered view that it is not a fit case to grant bail to the petitioner.
