ORDER:

This Writ Petition is filed for a mandamus to declare the action of the respondents in declaring the petitioner as having failed in MBBS Part II Final Year examination held in the month of February, 2012 in the two subjects, namely, Medicine Practical Examination and Surgery (Theory and Oral), as illegal and arbitrary.

At the hearing, learned counsel for both the parties have submitted that during pendency of this Writ Petition, the petitioner has appeared for fresh examinations and was declared passed and has been doing his internship.

In the light of the above events taken place subsequent to the filing of the Writ Petition, the cause in the Writ Petition does not survive for adjudication. However, the petitioner shall be free to avail appropriate remedy in the event he is sought to be disqualified for admission into Post Graduate Course only on the ground of his failing in the two subjects of Part II Final Year Examination which is the subject matter of this Writ Petition.

Subject to the above observation, the Writ Petition is disposed of as infructuous.

As a sequel to disposal of Writ Petition, WPMP.No.5834 of 2013 filed by the petitioner for interim relief is disposed of and WPMP.Nos.21765 of 2012 and 10905 of 2013 and WVMP.No.2285 of 2013 are disposed of as infructuous.
