THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.22763 OF 2012 DATED 24th JUNE, 2015 Between:

Kampasati Ramakrishna .. Petitioner and The Superintendent of Police, Eluru, West Godavari District and others .. Respondents

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.22763 OF 2012

O R D E R

This writ petition was filed assailing the action of the police authorities in not closing the rowdy sheet opened in the name of the petitioner on the file of the Chintalapudi Police Station, West Godavari District.

Sri S. Appadhara Reddy, learned counsel for the petitioner, stated that after the institution of the case the petitioner filed representation dated 07.12.2013 requesting the authorities to close the rowdy sheet. Thereupon, the Sub-Inspector of Police, Chintalapudi Police Station, addressed letter dated 23.07.2014 to the Superintendent of Police, West Godavari District, recording therein that the petitioner was earlier involved in five criminal cases but his case warranted consideration as he was not involved in any criminal activity thereafter. Sri Appadhara Reddy, learned counsel, states that the petitioner was acquitted in three out of the five cases referred to by the SubInspector of Police, Chintalapudi.

In any event, as the police authorities are now seized of the matter and the representation made by the petitioner, which was duly forwarded to the Superintendent of Police, West Godavari, by the Sub-Inspector of Police, Chintalapudi, under letter dated 23.07.2014, is awaiting consideration, this Court does not propose to adjudicate the issues raised in this writ petition on merits.

The writ petition is accordingly disposed of directing the Superintendent of Police, West Godavari District, to consider the petitioner's representation and the letter dated 23.07.2014 addressed by

the Sub-Inspector of Police, Chintalapudi, and take appropriate action in the matter as regards the maintenance of a rowdy sheet in the name of the petitioner on the file of the Chintalapudi Police Station. Reasoned orders shall be passed in this regard under communication to the petitioner. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
