THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34138 of 2018 ORDER:

When the matter is taken up, written instructions dated 24.10.2018 furnished by the Palakoderu Police Station, West Godavari District are placed on record by the learned Government Pleader for Home.

To the extent of their relevance to the present writ petition, the said instructions read as under:

"It is submitted that the investigation revealed that due to civil litigation, the complainant lodged false complaint against the accused persons. In this connection the Sub Divisional Police Officer, Narsapuram accorded permission to refer the case as false vide C.No.1000/Crime/refer/SDPO-NSP/2018, dated 09.10.2018. It is submitted that after serving the notice to the complainant on 22.10.2018, the final report was filed on 24.10.2018 vide S.R.No.10634/18 before the Hon'ble II Additional Judicial Magistrate of First Class, Bhimavaram, West Godavari District."

On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.

Accordingly, the writ petition is disposed of by placing on record the written instructions dated 24.10.2018 furnished by the Palakoderu Police Station, West Godavari District and leaving it open to the petitioner herein to avail alternate remedies available, in accordance with law. There shall be no order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
