THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.20757 of 2017 ORDER: (per SK,J) The prayer of the petitioners in this case reads as under: 'For the reasons stated in the affidavit filed in support of the writ petition, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction more in the nature of a Writ of Mandamus declaring the order of the Debts Recovery Tribunal at Hyderabad in I.A.No.1454 of 2017 in S.A.No.336 of 2011 dated 07.06.2017 as erroneous, violative of the Principles of Natural Justice, contrary to the earlier order of Debts Recovery Tribunal dated 16.12.2011 land consequently set aside the same and further direct the Debts Recovery Tribunal to consider the condone delay petition on merits and pass such other order or orders in the interest of justice.' S.A.No.336 of 2011 was filed by the petitioners before the Debts Recovery Tribunal-I, Hyderabad, in relation to their loan account with the Vijaya Bank.
While so, Sri V.V.Ramana, learned counsel for the Vijaya Bank, would inform this Court that the loan account, in relation to which the proceedings under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, were initiated, has since been closed.
In the light of this development, challenge in this writ petition to the order passed by the Tribunal in S.A.No.336 of 2011 no longer survives for consideration.
