HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34149 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 4 and 5 in not receiving the documents/sale deed presented by the petitioner relating to the land admeasuring Ac.0.19 cents, situated at Peddakakani Village and Mandal, Guntur District, as arbitrary and illegal.

It is the case of the petitioner that her husband is the owner and possessor of the subject land as it was inherited from her father-in-law. While thing stood thus, on 17.9.2018, the petitioner approached the 5th respondent, for issuance of market value certificate. The 5th respondent refused to issue the same and also refused to receive the documents presented by the petitioner, by paying the requisite stamp duty and registration charges. Hence, the present writ petition. The learned Government Pleader for Revenue, on instructions, would submit that the Mandal Parishad Development Office and Zilla Parishad High School are situated in the subject land and the same belongs to Zilla Parishad property, as per the revenue records and hence the documents presented by the petitioner, was not entertained. However, the 5th respondent-Sub Registrar, may be directed to deal with the issue in terms of Section 71 of Registration Act, 1908 (for short, "the Act").

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 5th respondent-Sub Registrar, to receive and deal with the documents presented by the petitioner for registration in terms of Section 71 of the Act, as early as possible, preferably within a period of two to three weeks from the date of receipt of copy of this order. If the 5th respondent wants to return the

documents presented by the petitioner, he may do so, by assigning valid reasons, for doing so, as stated in the provisions of the Act. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
