2016-04-01M.S.Ramachandra Rao2 pages

HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.10721 of 2016 ORDER:

Heard the learned counsel for the petitioners, learned Government Pleader for Revenue appearing for respondent Nos1 to 3 and the learned Government Pleader for Stamps and Registration appearing for Respondent No.4.

2.

It is stated by the learned counsel for the petitioners as well as the learned Government Pleader for Revenue appearing for respondent Nos.1 to 4 that the issue raised in this Writ Petition is covered by the order dt.12-12-2012 in W.P.No.34689 of 2012.

3.

Therefore, for the reasons alike, this Writ Petition is also disposed of in terms of the said order and the 4th respondent is directed to receive, register the documents as may be presented by the petitioners subject to the petitioners applying with the provisions of the Registration Act, 1908 and the Indian Stamp Act, 1899 unless there is an order of injunction against alienation of properties in question by a Court of competent jurisdiction. It is clarified that the injunction order said to have been granted by the Madras High Court in Contempt Petition No.1205 of 2010 would not operate in the State of Andhra Pradesh and that order cannot be treated as an order passed by the Court having competent jurisdiction.

No costs.

4.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
