HCJ&Dr.SA,J W.P.No.34371 of 2018 ORDER: (Per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) Mr. M. V. Rama Rao, the learned counsel for the respondent No.2, informs this Court that the preliminary examination has already taken place. According to the results declared with regard to the preliminary examination, the petitioner is not qualified for the post for which he had applied. Therefore, the learned counsel submits that the entire case has become infructuous.
On the other hand, Mr. Ramesh Chilla, the learned counsel for the petitioner, submits that the petitioner is still aggrieved by the notification dated 31.05.2018 and the notification dated 06.06.2018. Therefore, the legal issues are still alive. Heard the learned counsel for the parties.
Considering the fact that the petitioner has not qualified in the preliminary examination, no relief can be given to him by this Court. Hence, obviously, this Court would have to exercise its writ jurisdiction for answering an academic question. However, there is no need for this Court to go into an academic question. Therefore, this Court is of the opinion that this writ petition has become infructuous; it is hereby dismissed as infructuous. There shall be no order as to costs.
The miscellaneous petitions pending, if any, shall stand closed.
