THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.882 OF 2015 ORDER: (per SK,J) Sri V.Ananth Kumar, learned counsel representing Sri D.Suresh Kumar, learned counsel for the petitioners, and Sri G.Venkateshwarlu, learned counsel representing Sri K.Lakshman, learned Assistant Solicitor General for India, state before this Court that the issue arising for consideration in this case is squarely covered by the decision of this Court in W.P.No.1835 of 2015. A copy of the order dated 11.06.2018 passed in the said writ petition is placed on record.
For reasons alike as were stated in the aforestated order and in terms thereof, the writ petition is disposed of setting aside the order dated 14.08.2014 passed in O.A.No.461 of 2014 by the Central Administrative Tribunal, Hyderabad Bench, Hyderabad, and remanding the O.A. to the Tribunal for consideration afresh of the rival contentions of the parties.
As it is stated that certain subsequent developments would also need to be brought to the notice of the Tribunal, liberty is given to the petitioners to file an additional affidavit along with supporting material before the Tribunal and thereupon, the respondents in the O.A. shall be granted time to file their counter-affidavit. The Tribunal shall thereafter hear the matter on merits and pass fresh orders in accordance with law. The writ petition is allowed to the extent indicated above.
