THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION NO.9197 OF 2017 ORDER:

Petitioners, who are A1 to A4 in Cr.No.217 of 2017 on the file of Station House Officer, Denkada Police Station, Vizianagaram District, registered for the offences punishable under Sections 420, 354, 323, 354 (b) and 509 r/w 34 IPC, filed this petition under Section 438 Cr.P.C. seeking anticipatory bail.

As seen from the record, it is evident that the petitioners herein also filed W.P.No.33006 of 2017 on the file of this Court and the same was disposed of on 27.09.2017 with the following observation.

"Having regard to the above, there is nothing to quash the F.I.R. by entertaining the writ petition, but for to say the petitioners shall not be arrested for Ten (10) days from today. In the meantime, the petitioners can pursue their remedies available under law. Needless to say, for the offences punishable below seven years, the police strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court in Arnesh Kumar V State of Bihar.1"

In view of orders passed by this Court in the above writ petition, no further orders are necessary in this petition.
