HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.4211 OF 2017 ORDER:

This petition is filed under Section 437 and 439 Cr.P.C. by the petitioners/ A-2 and A-3 seeking regular bail in Crime No.27 of 2017 of Rajanagaram Police Station, East Zone, Rajamahendravaram (Urban) wherein they allegedly committed offence under Section 8 (c), r/ w 20(b)(ii)(c) of NDPS Act.

The accusation is that on 09.02.2017 on credible information that ganja was being illicitly transported, Circle Inspector of Police, Rajanagaram Police Station along with staff and mediators went to NH 16 towards Rajanagaram and conducted vehicle check opposite to GSN Petrol Bunk and during that course observed one TATA AICHER Van bearing No. AP-28-TB-5829 was proceeding from Jaggampeta towards Rajahmundry side wherein A-1 to A-3 were present. The police intercepted the vehicle and on suspicion they searched the vehicle and found 234 ganja packets in 13 bags weighing about 468 kgs. worth Rs.23,40,000/ -. The accused were arrested. Hence, the charge.

Bail is pleaded mainly on the submission that the petitioners are innocent and they were falsely implicated in the case. Perusal of C.D. file shows a strong prima facie case against the accused, in whose presence and possession the contraband was seized which is of commercial quantity. Having regard to the gravity
