HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.483 OF 2014 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973, requesting to quash the proceedings in C.C. No.356 of 2013 on the file of the I Additional Judicial Magistrate of First Class, Kadapa.

The petitioners are arraigned as accused Nos.2 to 6 respectively, in the aforesaid Calendar Case. They alleged to have committed the offences punishable under Sections 498-A and 506 IPC and under Sections 3 and 4 of Dowry Prohibition Act. Heard Sri M.N. Narasimha Reddy, learned counsel for the petitioners, learned Public Prosecutor appearing for the State of Andhra Pradesh and Sri P.V. Vidya Sagar, learned counsel for respondent No.2 - de facto complainant.

The learned counsel for the de facto complainant would submit that since no stay was ordered in the present petition, trial was conducted, all the witnesses have been examined except the Investigating Officer and in fact, the Calendar Case was transferred to Judicial Magistrate of First Class - cum - Special Mobile Court, Kadapa from the I Additional Judicial Magistrate of First Class, Kadapa and renumbered as C.C. No.146 of 2015. The learned counsel also placed deposition of the first witness (LW.1) who was examined on 18.08.2015. In such an event, certainly, it is not the

stage to consider the quash petition when full-fledged trial is under process and almost at the stage of conclusion. Therefore, the Criminal Petition is dismissed. As a sequel thereto, Miscellaneous Petitions, if any, pending in the petition, stand closed.
