THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12212 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue writ of Mandamus to declare the action of respondents for not arranging the service benefits of the petitioner's late father Sri P. Gangadhar, Driver, E.No.306868, and for not providing employment on compassionate grounds to the petitioner for the post of conductor under the bread winner scheme as arbitrary, discriminating as well as in violation of Article 14, 16 & 21 of Constitution of India and consequently the petitioner pray this Hon'ble Court may be pleased to direct the respondents to arrange all the service benefits of the petitioner's late father in terms of award made in I.D.No.45/2011 to the petitioner's mother P.Ganganarsu including providing employment to the petitioner for the post of conductor on compassionate grounds in the interest of justice and fair play."

Heard Sri V. Narasimha Goud, learned counsel, appearing for the petitioner and Sri N. Vasudeva Reddy, learned Standing Counsel, appearing for the respondents.

During the course of hearing, it is submitted by the learned counsel for the petitioner herein that the petitioner herein may be permitted to make a representation afresh to the respondents for redressal of the grievance of the petitioner and the same may be directed to be disposed of, in accordance with law, by fixing some timeframe. The said request is not opposed by other side and submitted that the said representation would be disposed of, in accordance with law.

For the aforesaid reasons and having regard to the nature of controversy, Writ Petition is disposed of, permitting the petitioner herein to submit representation afresh to the respondents, within a period of one month from the date of receipt of a copy of this order, and if any such application is submitted within the time stipulated, the same be considered and appropriate orders be passed, in accordance with law, within a period of three (3) months thereafter.

Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. There shall be no order as to costs.
