THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2031 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.1 to 12 seeking to quash the F.I.R.No.16 of 2016 of WPS Karimnagar, for the offences under Section 498-A of I.P.C. and Sections 3 and 4 of Dowry Prohibition Act.

Heard the learned counsel for the petitioners/accused Nos.1 to 12 and the learned Public Prosecutor and perused the material available on record.

Admittedly, the F.I.R. in this case was registered on the basis of reference made under Section 156(3) Cr.P.C. by the learned Magistrate. Even though the learned counsel for the petitioners contended that the learned Magistrate has not followed the procedures in forwarding the complaint for registration of the same, he could not able to produce any document to substantiate the same.

In any event, taking into consideration the fact that the matter is arising out of matrimonial dispute, the police concerned are directed to complete the

investigation without arresting the petitioners/accused and file the final report in accordance with law. The petitioners/accused are directed to appear before the Investigating Agency as and when their presence is required, and cooperate with the Investigating Agency.

With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
