THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.16186 of 2024 ORDER:

This Criminal Petition is filed under Section 483(1)(b) of Bharatiya Nagarik Suraksha Sanhita, 2023 to relax the condition imposed by the I Additional District and Sessions Judge, Ranga Reddy District, L.B.Nagar, by order dated 30.11.2024 in Crl.M.P.No.2408 of 2024 in Crime No.1289 of 2024 that "to file personal bond of Rs.20,000/- with 2 (Two) Sureties" by modifying the same as directed the learned VII Additional Metropolitan Magistrate, Ranga Reddy District, L.B.Nagar to accept the personal bond of Rs.5,000/- with 2 (two Sureties) of the accused No.2.

Heard Sri Baglekar Akash Kumar, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent.

Learned counsel for the petitioner submitted that the trial Court while allowing the Crl.M.P.No.2408 of 2024 directed the petitioner to comply the conditions passed therein.

Learned counsel further submitted that as per the conditions the petitioner shall be enlarged on bail on their execution of personal bond for a sum of Rs.20,000/- with two sureties for like sum each to the satisfaction of the VII Additional Judicial Magistrate of First Class, Ranga Reddy District at Hayathnagar and on condition that the petitioner has to appear before the SHO of PS Vanasthalipuram on every Sunday in between 10.00 - 12.00 AM for a period of two months or till filing of the charge sheet whichever is earlier. He further submitted that the petitioner is in jail from 06.10.2024 and modify the condition to reduce the surety amount Rr.5,000/- with two sureties and prayed the Court to modify the said conditions. 4.

Having regard to the submissions made by the learned counsel for the petitioner, this Court is inclined to modify the order dated 30.11.2024 in Crl.M.P.No.2408 of 2024 in Crime No.1289 of 2024, passed by the learned I Additional District and Sessions Judge, Ranga Reddy District, L.B.Nagar only to the extent of the petitioner executing a personal bond with two sureties and the petitioner is directed to execute a personal bond of Rs.5,000/- with two sureties to the satisfaction of the concerned Court.

With the above modification, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall also stand closed.
