THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.839 of 2016 ORDER:

This Contempt Case is filed alleging violation of the order, dated 30.01.2015 passed by this Court in Writ Petition No.1384 of 2015.

Respondent No.2 - Tahsildar, Sabbavaram Mandal, Visakhapatnam District, filed a counter-affidavit asserting that the petitioner is in peaceful possession and enjoyment of zeroithi land to an extent of Ac.0.85 cents in Survey No.109 of Vedulanarava Village, Sabbavaram Mandal and that adjacent to the said land of the petitioner, there is a Government land to an extent of Acs.2.40 cents in Survey No.118 of Vedulanarava Village, Sabbavaram Mandal, and to protect such land, the officials have erected a Board therein stating that the land belongs to the Government, but not in the petitioner's land and that the respondents never visited the land of the petitioner and evicted him therefrom, as such, the question of his possession being disturbed is only an allegation without any basis. In view of the specific assertion of respondent No.2 that the Board has been erected in the land in Survey No.118 but not in

CKR, J C.C.No.839 of 2016 the petitioner's land in Survey No.109, it cannot be said that there is any contempt on the part of the respondents. In the event the petitioner is so sure that the Board has been erected by the respondent authorities in his land, he shall take necessary steps by approaching appropriate forum.

In those circumstances, the Contempt Case is dismissed. Miscellaneous Petitions, if any pending shall stand dismissed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 28th MARCH, 2018.
