THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26494 of 2016 ORDER:

Complaining inaction on the part of the 4th respondent Tahsildar, Singarayakonda Mandal in considering the representations dated 01.02.2015 and 14.03.2016 submitted by the petitioners seeking mutation of their names in the revenue records with regard to the land in an extent of Acs.2.82 cents in Survey No. 715/2 situated at Somarajupalli Village, Singarayakonda Mandal, Prakasam District, this Writ Petition has been filed. The case of the petitioners is that their father Sri Ponugoti Ramaswamy was assigned the abovesaid land and after his death, they have been in possession and enjoyment of the same and now they want to have their names mutated in the revenue records.

Learned Government Pleader for Revenue (Andhra Pradesh), on instructions, would submit that noticing violation of the conditions of patta, a notice came to be issued to the petitioners and thereafter, the patta was also cancelled. According to him, the said land was assigned to the 3rd parties, who are in possession and enjoyment of the same as of now.

In view of the submissions made by the learned Government Pleader and in the facts and circumstances of the case, the 4th respondent is hereby directed to consider and pass orders on the representations dated 01.02.2015 and 14.03.2016 and communicate the decision taken thereon to the petitioners, within a period of two weeks from today. As and when such communication is received by the petitioners, they are at liberty to take appropriate steps to redress their grievance, if subsists, thereafter. With this, the Writ Petition stands disposed of. No costs. Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
