When the matter came up for hearing, it is represented by the learned Public Prosecutor that the investigating agency filed charge sheet after investigation and the present proceedings sought for against the F.I.R no way survives and as such the petition becomes infructuous.
2) In the result, the petition is disposed of giving liberty to the petitioner to take further recourse against the taking of cognizance by the Magistrate. Miscellaneous petitions, if any pending, shall stand closed.
